Abstract With AI technology advancing at breakneck speed, positions such as customer service, data collection and basic accounting are gradually being replaced by intelligent systems; AI has all but become the "new employee" that cuts costs and improves efficiency for companies. Embracing AI and achieving technological upgrading is an inevitable choice for companies keeping pace with the digital economy. Many companies want to use AI to optimize their job structure, yet fear stepping on the landmines of labor law. Drawing on the latest arbitration precedents and the policy requirements of the Ministry of Human Resources and Social Security (人力资源和社会保障部, "MOHRSS"), and starting from companies' actual business needs, this article sets out the core legal issues in the process of AI replacing human labor, together with practical compliance guidance — helping companies avoid the minefield and achieve a win-win between technological upgrading and employment compliance.
